Korea, US Agree on SOFA Revision
한-미, SOFA 협상 타결
Clearing one of the major *stumbling blocks to bilateral ties, Korea and the United States yesterday reached an agreement on the revision of the Status of Forces Agreement (SOFA), which has *apparently improved Korean authorities' rights regarding criminal jurisdiction, environmental protection and other issues.

양국 협상의 가장 큰 걸림돌의 하나를 타결하면서, 한국과 미국은 어제 SOFA협정의 개정에 합의하여, 형사관할권, 환경보호 및 기타 문제들에서 한국의 지위를 개선시키게 되었다.
Song Min-soon, director-general of the Foreign Affairs-Trade Ministry's North American Affairs Bureau and U.S. Deputy Assistant Secretary of Defense Frederick Smith initialed the agreement governing *administrative affairs of 37,000 U.S. troops stationed here, *wrapping up a brief meeting in Seoul yesterday morning.

송민순 외교통상부 북미국장과 프레데릭 스미스 미 국방부 부차관보가 37,000명의 미군의 국내주둔에 관한 행정업무에 관한 한미주둔군 행정협정에 어제 아침 협상결과를 발표하면서 서명하였다.
The recent rounds of SOFA negotiations resumed in August, nearly four years after the talks were deadlocked over criminal jurisdiction and other issues in 1996. The two sides revised the agreement in 1991, and a new round of negotiations for *additional revision began in 1995.

최근의 SOFA협상은 형사관할권과 기타문제에 이견으로 1996년에 중단된 이후 거의 4년만에 8월에 재개되었다. 한미양국은 1991년에 개정한바 있으며 추가 개정을 위한 협상테이블은 1995년에 열렸었다.
``The revision will, in the long term, *contribute to maintaining a stable environment for U.S. troops stationed in the ROK (Republic of Korea) and to further *enhancing the *alliance between the ROK and the United States,'' a joint press statement reads.

"이번의 SOFA개정으로 대한민국에 주둔하고 있는 미군의 장기적이고 안정적인 지위를 유지하고 한미 양국의 유대를 더욱 강화시키게 될 것이다."
In a joint press conference following the meeting, chief delegate Song said, ``The revised SOFA *reflects the changes the Korean society has gone through in terms of its culture, politics and others.''

회담후 열린 합동기자회견에서 송민순대표는 "개정된 SOFA협정은 한국의 사회가 문화, 정치 및 기타 분야에서 높아진 위상을 반영하였다."라고 말했다.
Smith said, ``This is an important agreement in terms of *strengthening our relations. This revised SOFA will serve both our countries extremely well in the coming years.''

스미스대표는 " 이번 타결은 한미 양국의 관계를 돈독히 하는데 매우 중요한 발판이 된다. 이번 SOFA개정으로 한미 양국이 앞으로 편한 관계가 될 것이다. "라고 말했다.
First of all, the two countries agreed to advance the *timing of
transferring the *custody of the accused U.S. personnel to Korean authorities from the current ``upon completion of all judicial proceedings'' to ``at the time of indictment.''

무엇보다도, 양국은 기소된 미군의 신병을 한국에 인계하는 시점을 현재의 " 재판 종결후"에서 "기소시점"으로 앞당기는데 합의했다.
In case Korean authorities arrest U.S. personnel on charges of *murder or rape, they will have the right to maintain custody.
* murder or rape : 살인 혹은 강간
살인이나 강간을 저지른 미군을 한국에서 체포했을 경우, 미군의 신병을 인계하지 않고 계속 구금할 수 있게 될 것이다.
If U.S. personnel are arrested by U.S. military authorities, their custody will be transferred at the time of *indictment.

미군헌병에게 체포된 미군은 기소시점에 한국당국에 인계될 것이다.
In return, the Korean government agreed to step up protection of the rights of the accused.
그대신 한국정부는 구금된 미군의 권리보호 조치를 개선하기로 합의하였다.
``Some of the legal assurances, such as the right to counsel, are included in the current SOFA. This revision *amplifies some of these protections, such as the right to counsel, right to speedy trial, facilities for detention, and publicity surrounding trials,'' Smith said.

"현 SOFA협정에 인권조항들이 포함된다. 이번 개정에서 상담과 신속한 재판요구권리, 구금시설개선, 그리고 재판 환경의 보도 등과 같은 인권보호 조항을 강조하고 있다."라고 스미스 대표는 말했다.
